Terms of service
The deal between you and SiteSums. Short where it can be, specific where it has to be.
1. Who this is for
SiteSums is provided by Nikita-Jade Hancock ("we", "us") to businesses — sole traders, partnerships and companies in the trades. By creating an account you confirm you are acting for a business, and that you have authority to agree these terms on its behalf. Consumer protection law for individuals buying for personal use does not apply to a business account.
2. Your account
You sign in with a link sent to your email address, so that mailbox is your key. Keep it secure. You are responsible for everything done through your account. Tell us at once if you think someone else has access.
3. Plans, payment and cancellation
- Subscriptions are billed monthly in advance by card through Stripe, at the price shown when you subscribe. We will give at least 30 days' notice by email before any price change.
- You can cancel at any time in Billing. Your plan runs to the end of the period already paid for; we do not refund part-months.
- If a payment fails we will retry and email you. After 14 days without payment we may suspend the account; your data is kept for a further 60 days so you can export it, then deleted.
- Prices exclude VAT unless stated.
4. Templates you buy
Buying a template — through SiteSums or through our shop — gives your business a licence to use it, not ownership of it. You may fill it, brand it, and send the results to as many of your own clients as you like. You may not resell, redistribute, share the master file, or use it to build a competing product. Because templates are digital content delivered immediately, they are not refundable once made available to you, unless they are faulty — in which case we will fix or replace them.
5. Your documents are yours — and your responsibility
SiteSums helps you produce quotes, invoices, variations and other paperwork. The numbers, the VAT treatment, the descriptions and the promises in those documents are yours. We calculate what you tell us to calculate; we do not give tax, legal or accounting advice, and we are not responsible for a document being wrong, late, or unpaid. Check anything that matters before it goes to a client.
6. Your data
You own your data. We process it only to provide the service, as set out in the privacy policy and the data processing terms. You can export everything at any time, and delete your account and everything in it yourself. You are responsible for your clients' data being lawfully held — see the DPA.
7. Acceptable use
Don't use SiteSums to send spam, to store or send anything unlawful, to try to reach another account's data, or to overload or probe the service. Don't upload files you have no right to use. We may suspend an account that breaks these rules; where we can, we will warn you first.
8. Availability and changes
We aim to keep SiteSums available around the clock and will schedule maintenance outside UK working hours where we can. We may change or retire features; if a change removes something you rely on, we will tell you in advance. We may end the service altogether on 90 days' notice, during which you can export everything.
9. What we're liable for — and what we're not
- Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything that cannot lawfully be limited.
- Otherwise, our total liability to you in any twelve-month period is limited to the fees you paid us in that period.
- We are not liable for loss of profit, loss of business, or for indirect or consequential loss — including a client not paying you, a quote being wrong, or a document arriving late.
- We provide the service with reasonable skill and care. We do not promise it will be uninterrupted or error-free.
10. Ending things
You can close your account at any time from Settings. We may close an account for breach of these terms, or after non-payment as described above. When an account closes, its data is deleted as described in the privacy policy — export first.
11. The legal bits
These terms are governed by the law of England and Wales, and its courts have jurisdiction. If any part is found unenforceable the rest still stands. These terms, the privacy policy and the DPA are the whole agreement between us. We may update these terms; material changes will be emailed to you at least 14 days before they take effect, and continuing to use SiteSums after that date means you accept them.
